MULTIPARENTALIDADE NOS CASOS DE RECONHECIMENTO DE FILHO JÁ REGISTRADO: UMA SOLUÇÃO À LUZ DACONSTITUCIONALIZAÇÃODO DIREITO CIVIL.

We use an event study to capture the investor reaction to the first Newsweek Green Rankings in September 2009, a notable, multi-dimensional recent development in the rating of corporate environmental CSR performance. Drawing on stakeholder theory, we develop hypotheses about market investor reaction to the disclosure of new, relevant corporate environmental performance in both the short and longer term, whether market investors’ reaction reflects industry context, and whether firm-level contextual variables representing firm size, and market legitimacy significantly impacts the investor (...) reaction. We find that, for the sample of the largest 500 US firms ranked by Newsweek, investors react positively both to the raw and within-industry rankings of green performance in terms of both short-term and longer-term returns. Moreover, the investor reaction is significantly influenced by contextual variables such as firm size and firm market legitimacy. Our results are compatible with the inference that rating agencies like Newsweek serve a valuable information dissemination function such that investors in better ranked firms anticipate larger future cash flows due to more positive reactions from key stakeholders such as environmentally-conscious customers, employees, NGOs, regulators, and thus reward these firms with stock price increases. Finally, larger, more visible firms benefit more, while firms which have more market legitimacy benefit less. We believe these findings will be of considerable interest to scholars of environmental corporate social responsibility. (shrink)

The Portuguese animal rights movement has been extremely active in campaigning against bullfighting. Indeed, from 2002 to 2014, this was their main priority in terms of campaigns. In this article, I assess how these campaigns have been carried out, arguing that the animal rights movement in Portugal has been othering supporters and practitioners of bullfights in their campaigns. In other words, their campaigns have consisted of drawing a sharp contrast between bullfight supporters and practitioners and the rest of the population. (...) I argue that a consequence of this is that the speciesist practices of the majority of Portuguese have become normalised; consequently, leading to the reinforcement of some speciesist norms. We start by problematizing the way in which philosophical practice is generally conceived in our academic environment. In this article, we address an understanding of Philosophy as a process of serious and sincere investigation of existential questions and creation of theory. With this, we intend to question some of the most common diagnoses and solutions for the underdevelopment of philosophical practice in Brazil, as well as provide our contribution to the propagation of a philosophical practice that risks the leap from (...) commentary to creation. Portuguese: Thomas Nagel propõe uma conceção de objetividade que ele designada por “a perspetiva de lado nenhum”. Dependendo da área de conhecimento à qual será aplicada, esta perspetiva tem como requisito diferentes níveis de distanciamento de posições subjetivas. Todavia, de acordo com Jonathan Dancy e Alan Thomas, Nagel propõe dois modelos diferentes de objetificação, em vez de apenas um. Partindo das inter- pretações destes autores, mas acabando por divergir deles, proponho que estes dois modelos de objetificação são, na verdade, semelhantes. (...) O elemento fundamental para chegar a esta conclusão está no significado que “reflexão crítica” tem em cada um dos modelos. Neste artigo, argumento que “reflexão crítica” tem apenas um significado: distanciamento. Consequentemente, concluirei que a conceção de objetividade proposta por Nagel terá que ser entendida como excluindo perspetivas subjetivas. Mais especificamente, concluirei que esta conceção requer distanciamento absoluto de perspetivas subjetivas, independentemente da área de conhecimento em consideração. -/- /////// English: Thomas Nagel defends a conception of objectivity as the view from nowhere. This view, ideally, would require different degrees of detachment from subjective positions, depending on the area of knowledge to which it would be applied. However, in doing this, and according to Jonathan Dancy and Alan Thomas, Nagel formulates two different models of objectification. Starting from these authors’ interpretations, but essentially diverging from them, I argue that the two models of objectification are, in fact, similar. The key element to reach this conclusion is the meaning of “critical reflection” in each one of the models. Given my argument that “critical reflection” has only one meaning – detachment –, Nagel’s conception of objectivity cannot include subjective perspectives in it; in fact, it requires absolute detachment from those subjective perspectives, independently of the area of knowledge being considered. O objetivo deste artigo é retomar a leitura de Marcelo Marques do conceito de imagem do Sofista de Platão, tendo como recorte o capítulo sobre a “Aporía” do livro Platão, pensador da diferença. Além de retomar essa leitura, pretende-se reconstruir as pontes sugeridas pelas epígrafes que o comentador retirou de Faulkner e de Guimarães Rosa para ilustrar o estatuto paradoxal das imagens, que são definidas no diálogo platônico como um tipo de ser que é, mas que não é aquilo que (...) é. Com isso, pretende-se avaliar algumas imagens literárias utilizadas para falar de imagens na teoria filosófica de Platão. (shrink)

In the third book of Republic, Plato analyzed the epic, the tragedy and the dithyramb styles of narration, explaining a little how is the lógos of what the poets say. Aristotle dealt with it when he talked about the poetic lexis, at times in the Poetic, stating that the dialogue is the meter discovered by the tragedy, and at other times in the Rhetoric, stating that the dialogue is the most dramatic way to write. Before this general aspect of exchanges (...) among the characters, the notion of imitation of the Socratic talks in Plato deserves new reflections, mainly aiming to understand what is being disputed in the quarrel between philosophy and poetry in the tenth book of Republic and, also, how much Plato radically goes apart from a simple drama. Widespread cross-cultural and cross-ideological agreement on the justifiable limits of war has become an increasingly complex yet vital element of global peace and conflict policies. Luís Cordeiro-Rodrigues and Danny Singh bring together a truly international cohort of philosophers, ethicists, political scientists, criminologists, sociologists, and other scholars to address the morality of war from a comparative perspective. The COVID-19 pandemic requires emergency policies to be put in place in order to avoid a global health catastrophe. At the same time, there has been an increasing preoccupation that argues urgent policies for public health neglect social justice. By looking at Portugal’s successful confinement case during the early stages of the pandemic, I argue that ethically driven social justice policies are not just compatible but also an instrumentally important element in addressing this pandemic in an effective way. The Portuguese (...) case study suggests that enhancing social justice towards socio-economically vulnerable groups correlates with the prevention of the spread of COVID-19; these benefits to public health can be explained by the fact that those policies create social distancing and less exposure to the COVID-19 virus and other contagious diseases and also remove disincentives to the use of healthcare services. In this paper, we intend to demonstrate that the asylum request process can have its semantic and politic structures evidenced from an access via philosophy of language. In order to elucidate the normative nature of this social practice and to take a critical stance in relation to the treatment given to the refuge interview as it has been done in our country, we resort to certain concepts developed by the so called later Wittgenstein. Looking for a more complete treatment of (...) our object of study, we also turn to the authors of Bakhtin’s Circle, which explore communicational dimensions that the Viennese philosopher did not properly explore – with special emphasis on “value accents”. In order to collect empirical evidence relevant to our purposes, a field research was carried out with professionals and volunteers involved in the asylum request interviews. The resulting reports provided us with more basis for the considerations we make about the normative fragility of the interview language game and the intricate value system that guides the interaction between interviewer, interpreter and interviewee. Para tanto, recorro ao tratamento precursor conferido por I.A. Richards ao tema da metáfora na obra intitulada The Philosophy of Rhetoric e proponho complementações ao mesmo a partir de uma concepção de aprendizado da linguagem de orientação wittgensteiniana.

In this article we address Foucault’s interpretation of Kant’s anthropology as a whole, i.e. beyond Anthropology from a Pragmatic Point of View . I expose Foucault’s three most important thesis, which concern firstly the faithfulness of this book to the critical work that preceded it; secondly, the need of reading the Introduction to the Logic and the Opus postumum in order to draw crucial aspects of Kant’s anthropology; and thirdly, the importance of reviving a critical gesture , so as to (...) demystify the pretensions of the post-kantian anthropological discourse. This way the difference between Foucault and Heidegger on the one side, and Foucault and Sartre on the other side, becomes clear: against the latter he adopts an anti-humanist perspective, and unlike the former he uses the Opus postumum to distinguish false anthropology from Kant’s anthropology.Neste texto analisamos a leitura que Foucault fez da antropologia kantiana no seu conjunto, isto é, para além da Antropologia de um ponto de vista pragmático . As três teses foucaultianas mais importantes são, primeiro, a da fidelidade deste livro à obra crítica que o precedeu; segundo, a da necessidade de ler a Introdução da Lógica e o Opus postumum para penetrar aspetos essenciais da antropologia de Kant; terceiro, a da importância de retomar um certo gesto crítico , para desmistificar as pretensões do discurso antropológico pós-kantiano. Neste percurso, torna-se nítido o modo como Foucault se distingue tanto de Heidegger quanto de Sartre: se se opõe a este por via do anti-humanismo teórico, também se diferencia de Heidegger pela forma como se serve do Opus postumum, que Heidegger praticamente ignorou. Foucault’s main thesis in his Introduction to Kant’s Anthropology is that the meaning of Anthropology from a Pragmatic Point of View can only be entirely grasped in the light of certain notes concerning the human being, assembled in the Opus Postumum. He asserts that the discourses held on human beings in the Anthropology and the introduction to the Logic are temporary – though necessary – moments in the transition from the critical to the transcendental philosophy: the latter is the accomplishment (...) of Kantian philosophy, to which the former was only a Propädeutik. In this paper I call this a ‘teleological reading’ of the Anthropology, one which certainly has the merit of integrating this book in the evolution of Kant’s thought, but which can also be misleading, since it rarely considers the book Anthropology in itself. Hence, Foucault carries out what is more of a study of ‘Kant’s philosophy from an anthropological point of view’ rather than a study of the Anthropology. In the end, I also indicate the way in which this method enables us to distinguish his philosophical position both from Heidegger’s interpretation of Kant and from Sartre’s humanism. (shrink)

The rapid development of AI in recent years has brought the problem of AI's moral status to the fore. In this article, we combine Afro-communitarian ethics with a cognitive perspective and argue that some AI can hold a moral status to the extent that it can be both a subject and an object of communion. Further, different kinds of AI have different degrees of moral status, depending on their communal capacities. To demonstrate this, we show that AI can engage in (...) moral behavior and be morally disposed to act in certain ways. In ‘Towards an ethics of pronatalism in South Korea (and beyond)’1 JY Lee thoughtfully critiques the South Korean government’s efforts to boost its record-low fertility rate from an ethical (rather than effectiveness2) perspective. I broadly align with Lee’s ethical concerns regarding possible state-sponsored coercion and the instrumentalisation of citizens for the national interests whether with South Korean government-backed pronatalism or incentivised sterilisations in Indian states. What I want to challenge here is the plausibility of the ‘and beyond’ part of her (...) title, which seems to extend their reach beyond the Korean context. To this end, I explore the acceptability of Lee’s positions given significant cross-national variation in economic, social, structural conditions and value. Below, I sequentially address her proposals: moving beyond treating symptoms to uncovering and remedying an aetiology that is often grounded in oppressive social norms, addressing systematic social injustices especially those impacting women and avoiding human instrumentalization by the state. Marked variation in economic, political and social forces and conditions evident across nations (and even across the very diverse states in the Indian case) can significantly impact the urgency assigned to marked fertility declines (and the associated prospect of declining future economic growth, support for the elderly and social stability) need …. The COVID-19 pandemic has brought significant challenges to healthcare systems worldwide, and in Africa, given the lack of resources, they are likely to be even more acute. The usefulness of Traditional African Healers in helping to mitigate the effects of pandemic has been neglected. We argue from an ethical perspective that these healers can and should have an important role in informing and guiding local communities in Africa on how to prevent the spread of COVID-19. Particularly, we argue not only (...) that much of the philosophy underlying Traditional African Medicine is adequate and compatible with preventive measures for COVID-19, but also that Traditional African Healers have some unique cultural capital for influencing and enforcing such preventive measures. The paper therefore suggests that not only given the cultural context of Africa where Traditional African Healers have a special role, but also because of the normative strength of the Afro-communitarian philosophy that informs it, there are good ethical reasons to endorse policies that involve Traditional Healers in the fight against COVID-19. We also maintain that concerns about Traditional African Healers objectionably violating patient confidentiality or being paternalistic are much weaker in the face of COVID-19. (shrink)

A condição humana e a condição docente: das ilusões de onipotência ao reconhecimento do desamparo Resumo: Partindo do princípio de que todo processo educacional é aberta ou veladamente guiado por uma determinada maneira de se compreender o ser humano, procuramos nesse artigo colocar em questão os ideais de “humano”, e consequentemente, de humano-professor, que a tradição ocidental nos legou. Em seguida, tentamos indicar alguns caminhos para repensarmos contemporaneamente o que significa ser humano e, por conseguinte, o que significa ser professor. (...) Enquanto os antigos ideais insistem em projeções de poder e invulnerabilidade ao assumir uma essência imaterial para o humano, apostamos numa concepção de humano encarnado, afetivo e desejante que envolve, em contrapartida, a disposição para assumirmos o irremediável desamparo e a incontornável vulnerabilidade que são intrínsecos à condição humana. Palavras-chave: condição humana; ilusões de onipotência; desamparo The human condition and the teacher condition: from the illusions of omnipotence to the recognition of helplessness: Assuming that every educational process is openly or veiled guided by a certain way of understanding the human being, we seek in this article to question the ideals of "human," and consequently of human-teacher, that the Western tradition bequeathed to us. Next, we try to indicate some ways to rethink contemporaneously what it means to be human and, therefore, what it means to be a teacher. While the old ideals insist on projections of power and invulnerability by assuming an immaterial essence for the human, we bet on an incarnate, affective and desiring human conception that involves, on the other hand, the disposition to assume the irremediable helplessness and the unavoidable vulnerability that are intrinsic to the human condition. Tentativa de estabelecer um monismo pulsional a partir do conceito nietzschiano de vontade de poder e o conceito freudiano de princípio de prazer. Nossa intenção é unificá-los na ideia de uma pulsão existencial originária, presente e efetivamente atuante em todos os processos existenciais – a pulsão de poder absoluto.

In this article, I investigate to what extent future generations that belong to language minorities are entitled to group rights that protect their linguistic identity. In particular, I assess whether these future generations are entitled to assistance rights, symbolic claims, self-government rights and exemptions from the law. To address this I outline three arguments supporting group rights for current generations and raise the question of whether these arguments, which are true for current generations, will also be true for future generations. (...) The answer defends the entitlement of future generations to group rights against two counterarguments. The first is that future generations have no interest in preserving their language and therefore there is no normative justification for group rights. The second is that there is a duty to eliminate group rights in order to avoid malign consequences of these rights for future generations. (shrink)

Any experimental field consists of preparing special conditions for examining interesting objects for research. So naturally, the particular ways in which scientists prepare their objects determine the kind and the content of knowledge produced. This book provides a framework for the analysis of experimental practices - the Social Epistemology of Experiment - that incorporates both the ‘material’ and the ‘social’ dimensions of knowledge production. The Social Epistemology of Experiment is applied to experimental economics and in so doing, it introduces the (...) epistemic role of the participation of human subjects in experiments and the causal efficacy of institutions in constraining and enabling human behaviour. It also develops the role of the social and socially established practices in overcoming the methodological difficulties associated with experimenting with humans subjects in the social sciences as well as the effect of scientists’ interventions in the laboratory worlds. This book provides an historical and contextualized account of the emergence of experimental economics, the methodological discussions that have informed and constituted it, its main research programmes, and stylized facts. The analysis of its three main research programmes – market experiments, game theory experiments and individual decision-making experiments – shows how economics experiments are particularly tailored to produce knowledge about market institutions and individual behaviour in contexts where there might be conflicts of individual and social goals, and also about the processes of individual decision-making. Given the need to explore the factors that can account for a better understanding of the intention-behavior gap in exercise practice in health club settings, and considering the emergence of hedonic assumptions related to exercise adherence, this cross-sectional study aimed to test the moderation effect of the intensity traits agreement/disagreement in three relevant outcomes of exercise enjoyment: exercise habit, intention to continue exercising, and exercise frequency. A sample consisted of 273 exercisers (male = 127; Mage = 36.21; SD = 11.29) (...) enrolled in nine health clubs who voluntarily fulfilled a battery of questionnaires. All analyses were performed using SPSS v. 23.0/PROCESS v. 3.5. The results of the study presented a moderation effect of exercise intensity traits agreement on three relevant enjoyment outcomes: exercise habit, intention to continue exercising, and exercise frequency. No relevant results emerged from intensity traits disagreement. The results suggest that assessing and tailoring exercise prescription and supervision in order to customize exercise intensity may influence future exercise participation. (shrink)

Igwebuike is a traditional knowledge system undergirded by the metaphysical assumption that the world is a totality of interconnected and interrelated entities.1–4 African scholars in West Africa often invoke igwebuike to make sense of African ethical, social and political perspectives that are grounded in the theory of Afro-communitarianism. Afro-communitarianism is primarily a socioethical theory that is concerned with the articulation of the moral relationship between the individual and the community. The term igwebuike is derived from the Igbo root words igwe (...) (number), bu (is) and ike (strength). Thus, the term igwebuike translates as ‘number is strength’.3 4 As an ethical theory, igwebuike espouses the ontological relatedness of the variety of entities in the world and the moral relatedness of all humans by virtue of their common possession of life, with the accompanying human capacity for feeling and thinking. Resultantly, it prescribes solidarity, companionship and identification with others as virtues that promote human flourishing. The reverence for life and humanness explicitly forbids actions that diminish this superlative and irreplaceable quality.5 This concept can be helpful in offering a conceptual framework for making healthcare more ….
